You are requested to read the following points carefully before booking the consignment, You may carefully note that your consignment must not contain any letter of communication that will infringe the INDIAN POSTAL ACT. 1983. Cheques, Drafts, Files, Stationery, Documents, Negotiable Instruments, Banking Papers, L.Cs and such other documents are not barred from being sent through courier service. We accept envelopes/parcels in good faith that they do not contain anything that will infringe the Law. However the consignment should not contain any paper or documents which cannot be reconstructed in case of laws.
Consignments, which are of hazardous nature (chemicals, flammable articles and liquids) are expressly prohibited by the railway/airport authority or any other transport agency by the railways, shall not be accepted. We request you not to enclose cash in the courier consignment and not to book jewels, textiles, high value gift articles, share certificates and travel documents. Our liability in case of any loss or damage to the consignment shall not exceed Rs.100/- for within India movement of shipments, we request you to declare the value of the consignment in the consignment note at the time of booking. We request you to ensure that the consignment is properly packed with thick paper material to withstand the handling.
You should book all your tender documents in advance so as to reach their destinations on time. When booking such documents they should ensure that the Consignee full address, Designation, specific department name and Tender Opening Time are written legibly on the consignment. This will ensure prompt and speedy delivery. If more than one consignment is booked to the same consignee, it has to be ensured that the full address is written on all the consignments.
Consignments addressed to Ministry Offices and Central Government Offices in New Delhi are put in the box at the gate, for security reasons as per the direction of the Central Government. You have to hand over all their consignments before the specified CUT-OFF-TIME for on time delivery. The Company shall not be liable for any loss arising due to confiscation of shipments by any Government Agencies due to lack of proper documents.
You have to ensure their consignments if they contain valuable items. The company shall not be liable for any loss arising due to causes beyond its control such as Floods, Accidents, Fire, Theft, War etc. Every effort is made to adhere to the delivery schedule, but it may be delayed in the circumstances beyond our control. Octroi or any other charges levied by any Central/State/Local Authorities wherever applicable shall be extra and the consignor should pay it. The company is not liable for any loss, mis-delivery, delay or damage to any article/things/documents sent and no officer of the company is liable for any such loss, delay or damage, except to the extent of clause mentioned above in Sl.No.3.
Hub Cargo Lines Pvt Ltd has the right but not the obligation, to inspect any shipment without prior intimation to the consignor to check the contents. All matters of business should be settled within the jurisdiction of Mumbai Maharashtra. A proof of delivery can be made available on customer’s request and such a request should be made within 30 days of the dispatch of the consignment. No claims will be accepted after the time limit. Parcels shall be accompanied by the following forms to meet the requirements of sales tax authorities. Kerala – 27B, UP – 31A, Gujarat – Invoice/Declaration, West Bengal way bill 42 (Octroi payable for Gujarat, Haryana, Maharashtra, Punjab and Rajasthan). Consignments addressed to a post box number cannot be delivered.

Important Notice
When ordering Hub Cargo Lines Pvt Ltd services you, as ‘shipper’, are agreeing, on your behalf and on behalf of anyone else with an interest in the shipment, that the Terms and Conditions shall apply from the time that Hub Cargo Lines Pvt Ltd accepts the shipment unless otherwise agreed in writing by an authorized officer of THE Hub Cargo Lines Pvt Ltd. Your statutory rights and entitlements under any defined service feature (for which additional payment has been made) are not affected. ‘shipment’ means all documents or parcels that travel under one waybill and which may be carried by any means THE Hub Cargo Lines pvt Ltd chooses, including air, road or any other carrier. A ‘waybill’ shall include any label produced by THE Hub Cargo Lines pvt Ltd automated systems, air waybill, or consignment note and shall incorporate these Terms and Conditions. Every shipment is transported on a limited liability basis as provided herein. If the shipper requires greater protection, then insurance cover may be arranged at an additional cost. (Please see below for further information). Hub Cargo Lines Pvt Ltd means and includes any member of the Hub Cargo Lines Pvt Ltd Worldwide Express Network.
1. Customs, Exports and Imports
Hub Cargo Lines Pvt Ltd may perform any of the following activities on shipper`s behalf in order to provide its services to the shipper:
- Complete any documents, amend product or service codes, and pay any duties or taxes required under applicable laws and regulations.
- Act as the shipper`s forwarding agent for customs and export control purposes and as receiver solely for the purpose of designating a customs broker to perform customs clearance and entry.
- Redirect the shipment to the receiver`s import broker or other address upon request by any person who Hub Cargo Lines Pvt Ltd believes in its reasonable opinion to be authorized.
2. Unacceptable Shipments
The shipper agrees that its shipment is acceptable for transportation and is deemed unacceptable if:
- It is classified as hazardous material, dangerous goods, prohibited or restricted articles by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization) and any applicable government department or other relevant organization.
- No customs declaration is made when required by applicable customs regulations.
- The Hub Cargo Lines Pvt Ltd decides it cannot transport an item safely or legally (such items include but are not limited to: animals, bullion, currency, bearer form negotiable instruments, precious metals and stones, firearms, parts thereof and ammunition, human remains, pornography and any illegal narcotics/drugs).
3. Deliveries & Undeliverable
Shipments cannot be delivered to PO boxes or postal codes. shipments are delivered only to the receiver`s address given by the shipper (which in the case of mail services shall be deemed to be the first receiving postal service) but not necessarily to the named receiver personally. shipments addressed to a central receiving area will be delivered to that area. If the receiver refuses delivery or to pay for delivery, or the shipment is deemed to be unacceptable, or it has been undervalued for customs purposes, if the receiver is not reasonably identified or located, The HUB CARGO LINES PVT LTD shall make reasonable efforts to return the shipment to the shipper at shipper`s cost, failing which the shipment may be released, disposed off or sold by HUB CARGO LINES PVT LTD without incurring any liability whatsoever to shipper or anyone else, with the proceeds applied towards service charges and other related administrative costs and the balance if any of the proceeds of a sale is to be returned to the shipper.
4. Inspection
HUB CARGO LINES PVT LTD has the right to open and inspect a shipment without prior notice to the shipper.
5. Shipment Charges & Billing
HUB CARGO LINES PVT LTD will levy shipment charges as calculated according to the higher of actual or volumetric weight and any shipment may be re-weighed and re-measured by HUB CARGO LINES PVT LTD to confirm this calculation. The shipper shall pay or reimburse HUB CARGO LINES PVT LTD for all shipment charges, storage charges, duties and incurred taxes for services provided by HUB CARGO LINES PVT LTD or incurred by HUB CARGO LINES PVT LTD on shipper`s or receiver`s or any third party`s behalf and all claims, damages, fines and expenses incurred if the shipment is deemed unacceptable for transport as described in Section 2.
6. HUB CARGO LINES PVT LTD Liability
HUB CARGO LINES PVT LTD contracts with shipper on the basis that HUB CARGO LINES PVT LTD liability is strictly limited to direct loss only and to the per kilo/Ib limits in this Section 6. All other types of loss or damage are excluded (including but not limited to lost profits, income, interest, future business), whether such loss or damage is special or indirect, and even if the risk of such loss or damage was brought to HUB CARGO LINES PVT LTD attention before or after acceptance of the shipment since special risks can be insured by the shipper. If a shipment combines carriage by air, road or other mode of transport, it shall be presumed that any loss or damage occurred during the air period of such carriage unless proven otherwise.HUB CARGO LINES PVT LTD liability in respect of any one shipment transported, without prejudice to Sections 7-11, is limited to its actual cash value and shall not exceed the greater of US $100 or equivalent currency of the origin country. For all postal services our limited liability is only US $10 or equivalent currency of the origin country. Claims are limited to one claim per shipment settlement, which will be full and final settlement for all loss or damage in connection therewith. If the shipper regards these limits as insufficient it must make a special declaration of value and request insurance as described in Section 8 (shipment Insurance) or make its own insurance arrangements, failing which the shipper assumes all risks of loss or damage.
7. Time Limits for Claims
All claims must be submitted in writing to Hub Cargo Lines Pvt Ltd within thirty (30) days from the date that Hub Cargo Lines Pvt Ltd accepted the shipment, failing which Hub Cargo Lines Pvt Ltd shall have no liability whatsoever.
8. Shipment Insurance
Hub Cargo Lines Pvt Ltd can arrange insurance for the shipper covering the actual cash value in respect of loss or physical damage to the shipment, provided the shipper completes the insurance section on the front of the waybill or requests Hub Cargo Lines Pvt Ltd and pays the applicable premium. shipment insurance does not cover indirect loss or damage, or loss or damage caused by delays.
9. Delayed Shipments
Hub Cargo Lines Pvt Ltd will make every reasonable effort to deliver the shipment according to Hub Cargo Lines Pvt Ltd regular delivery schedules, but these are not guaranteed and do not form part of the contract. Hub Cargo Lines Pvt Ltd is not liable for any damage or loss caused by delays.
10. Circumstances beyond Hub Cargo Lines Pvt Ltd, control
Hub Cargo Lines Pvt Ltd is not liable for any loss or damage arising out of circumstances beyond Hub Cargo Lines Pvt Ltd control. These include but are not limited to:-`Act of God` – e.g. earthquake, cyclone, storm, flood, fog; `Force Majeure – e.g. war, plane crash or embargo; any defect or characteristic related to the nature of the shipment, even if known to Hub Cargo Lines Pvt Ltd riot or civil commotion; any act or omission by a person not employed or contracted by Hub Cargo Lines Pvt Ltd e.g. shipper, receiver, third party, customs or other government official; industrial action; and electrical or magnetic damage to, or erasure of, electronic or photographic images, data or recordings.
11. Warsaw Convention
If the shipment is transported by air and involves an ultimate destination or stop in a country other than the country of departure, the Warsaw Convention, if applicable, governs and in most cases limits Hub Cargo Lines Pvt Ltd liability for loss or damage.
12. Shipper’s Warranties and Indemnity
The shipper shall indemnify and hold Hub Cargo Lines Pvt Ltd harmless for any loss or damage arising out of shipper’s failure to comply with any applicable laws or regulations and for shipper`s breach of the following warranties and representations:
- All information provided by the shipper or its representatives is complete and accurate.
- The shipment was prepared in secure premises by shipper`s employees.
- The shipper employed reliable staff to prepare the shipment.
- The shipper protected the shipment against unauthorized interference during preparation, storage and transportation to Hub Cargo Lines Pvt Ltd.
- The shipment is properly marked and addressed and packed to ensure safe transportation with ordinary care in handling.
- All applicable customs, import, export and other laws and regulations have been complied with.
- The waybill has been signed by the shipper`s authorized representative and the Terms and Conditions constitute binding and enforceable obligations on the shipper.
13. Routing
The shipper agrees to all routing and diversion, including the possibility that the shipment may be carried via intermediate stopping places.
14. Governing Law
Any dispute arising under or in any way connected with these Terms and Conditions shall be subject, for the benefit of Hub Cargo Lines Pvt Ltd to the non-exclusive jurisdiction of the courts of, and governed by the law of, the country of origin of the shipment and the shipper irrevocably submits to such jurisdiction, unless contrary to applicable law.
15. APPLICATION OF COUNTRY SPECIFIC – TERMS & CONDITIONS
Since these terms and conditions are uniformly applicable to all countries in the world and are not exhaustive but subject to applicable laws of the country of origin, additional terms and conditions will be applicable to suit the compliance of the law of the land, as applicable.
16. Severability
The invalidity or unenforceability of any provision shall not affect any other part of these Terms and Conditions.
